The legality of Gov. Brown’s concurrence currently is pending before the California Supreme Court. That Court actually is considering two California Court of Appeal decisions on the legality of the Governor’s concurrence in BIA determinations. In the Enterprise case, the Court of Appeal in Sacramento upheld the concurrence. In the North Fork case, the Court of Appeal in Fresno held that the Governor lacked the authority to concur. The California Supreme Court will address the Enterprise case first. If it rules against the Governor, the casino may not be able to operate.
